Legal Protection for Sexual Assault/Abuse Victims
What is a Civil No Contact Order (CNCO)?
- The victim can obtain this protective order in civil court. The victim does not need to press criminal charges to receive this protective order.
- The victim needs only one incident of sexual assault or abuse to ask a civil court judge for this remedy.
- The Civil No Contact Order (CNCO) can order the perpetrator to stay away from the victim. This means the perpetrator cannot be at the victim’s home, school, work, daycare, church, synagogue or mosque while the victim is there.
- This is true even if the victim and the perpetrator attend the same school or house of worship, or work in the same place.
Who Can get a Civil No Contact Order (CNCO)?
A victim of sexual assault or abuse can ask the judge for this protection.
How Long Does the CNCO last?
The CNCO can last up to two (2) years after the judge issues the order.
What is Sexual Assault/Abuse under the CNCO Law?
Fondling or touching, even through clothes; penetration of the victim’s vagina and/or anus by any part of the abuser’s body, or with an object.
Do I need a Police Report?
A police report is not needed because Civil No Contact Orders are civil cases, not criminal cases.
Is Evidence of Semen Required?
Evidence of semen is not required, but if the abuser ejaculates on any part of the victim’s body this conduct is a reason to ask for a CNCO.
